What the inspector wrote

An unannounced case management inspection was conducted today on 2/5/26 at 2:08pm by Licensing Program Analyst (LPA), Tammy Dutra. LPA met with facility representative Bronwyn Allen in response to an Unusual Incident Report received by the Department on 2/4/26. An infant in care, C1 was left on the playground for approximately 15-20 minutes unsupervised during a transition. The director, Bronwyn Allen was interviewed on 2/5/26 at 2:38pm and stated that on at 2/4/26 she was informed by a staff member that an infant had been left on the playground for approximately 15 minutes. Director stated that she was not informed on the date of the incident but it was disclosed the following day. Director interviewed staff and created a timeline of events. During interviews she discovered that another child had been injured and teachers moved inside with infants to support another teacher in the copper cubs room. During that transition C1 was outside and none of the staff were aware C1 was missing. After breaks were completed a staff noticed C1 was missing and the lead teacher found C1 on the playground in the toy tree house. None of the staff informed the director after the incident and the parents were not informed until the director was informed the following day. Five staff were interviewed on 2/5/26 and all stated that they learned an infant was left alone on the playrgound for approximately 15-20 minutes. S1-S3 did not know that C1 was on the playground until after C1 was found. An injury occurred to another child in care and all children were quickly moved indoors. The center's system for counting and clearing the playground were not followed. The ratio boards were not updated and it was not discovered C1 was missing until S1 returned from their break. S3 & S5 both stated that C1 was whimpering, crying and red from the stress of being left alone outside. During today\342\200\231s inspection, the facility was toured and the playground was reviewed and took photos of the toy tree house that C1 was discovered in. It was observed that due to the placement of the tree house a visual of C1 inside would have been obscured. LPA also noticed a shed that has a blind spot on the infant playground. There are multiple blind spots. LPA advised director to visually check all blind spots whenever transitioning children from the outside to the classroom. LPA reviewed employee files and discovered all staff are up to date on mandated reporting responsibilities and infant qualified teachers. Systems were not followed during the incident to ensure that all children were accounted for. Infant playground is surrounded by a fence to prevent elopement. Based on interviews, playground review and record review LPA determined that the facility failed to provide constant supervision for an infant in care. The following deficiency is being cited on the LIC 809-D. Health and Safety Code 1596.99 (c)(3) LPA Tammy Dutra informed facility representative Bronwyn Allen that this report dated 2/5/26 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Tammy Dutra informed facility representative to provide a copy of this licensing report dated 2/5/26 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report was reviewed with the facility representative Bronwyn Allen. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
