What the inspector wrote

On 12/21/23 at 11:26am, Licensing Program Analyst (LPA) E. Laird conducted an unannounced case management inspection and met with licensee Angela Davis. Upon arrival to the home LPA observed the licensee caring for five children. LPA conducted interviews with licensee, staff, children, and witnesses. Based on information received, the following deficiency was cited: 102423(a)(4) Personal Rights (see LIC809D). LPA E. Laird informed licensee, Angela Davis, that this report dated 12/21/23 documents 1 Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA E. Laird informed the licensee to provide a copy of this licensing report dated 12/21/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview was conducted with licensee, Angela Davis and appeal rights were provided. Notice of Site visit shall remain posted for 30 days.

    102423 Personal Rights(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This regulation was not met as evidence by: Licensee is putting children outside as punishment. Licensee is having older children write sentences as punishment.
