What the inspector wrote

Licensing Program Analyst (LPA) Martinez conducted a phone interview with Director Heather Lingeman. It was alleged the facility is not following day care children's custody agreement with the authorized representative, specifically for the Parent (P1) of Child (C1) for pick up and custody days. The Director stated she did not receive the document for the custody agreement until May 17,2021 from the Parent (P1), even though it was signed and dated April 26,2021 by Butte County Superior Court. The Director stated she was confused upon receipt of the document as to who could pick up on P1's days. LPA Martinez received a copy of C1's pick up signatures and for 5/28 the document indicates that P2 picked up the child at 2:02PM. On 5/21 the same pick up signature document indicates the child was not taken to school on that day. The Director stated because of her confusion to the document she allowed P2 to pick up the child. On the Court Child Custody Agreement it does notate Special Holiday's which include 5/28 as the Memorial Holiday. This document states on the Friday of the Holiday weekend P1's time will start at 6pm Friday and end on 5pm Monday. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated. No citations were issued.
