What the inspector wrote

Provider Information Notice (Pin) 21-29-CCP FACE COVERING REQUIREMENTS AND GUIDANCE FOR CHILD CARE PROVIDERS REGARDING CORONAVIRUS DISEASE 2019 (COVID-19) was discussed and a copy was provided during the inspection. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days.

    (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:(2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. Based on observations/interviews, the licensee did not ensure the personal rights of children in care in that 7 of 7 children in care (C1 – C7) did not wear face coverings while in the facility, as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. This is a potential health and safety risk to children in care.
