What the inspector wrote

LPA Mendez toured the facility at 10:06am. LPA Mendez observed preschoolers/tk classroom playing inside as they transitioned to stations inside the classroom and only one child had a mask on. LPA Mendez observed COVID-19 guidelines posting at the front of lobby. There were a total of 24 children observed and 23 of them not wearing facial coverings. The children not wearing facial coverings (C1 – C24) were observed playing indoors. Provider Information Notice (Pin) 21-29-CCP FACE COVERING REQUIREMENTS AND GUIDANCE FOR CHILD CARE PROVIDERS REGARDING CORONAVIRUS DISEASE 2019 (COVID-19) was discussed and a copy was provided during the inspection Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days.

    The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not be as evidenced by: Based on observations/interviews/record reviews, the licensee did not ensure the personal rights of children in care in that 24 of children in care (C1 – C23) did not wear face coverings while in the facility, as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. This is a potential health and safety risk to children in care.
