Inspector’s narrative

What the inspector wrote

It was alleged that \342\200\234Licensee was operating over ratio/capacity. Throughout the investigation, LPA Nguyen conducted observations and interviewed with licensee, licensee\342\200\231s assistant, licensee\342\200\231s former assistant, parents, and Reporting Party. Based on interviews with licensee, licensee\342\200\231s assistant, and parents, LPA Nguyen obtained conflicting information. One individual stated that on some recent Thursday and/or Friday afternoons, there had been 16 and more children present in the facility. The facility is licensed for a total capacity of 14 children. Other individuals reported that Licensee and an adult assistant have been having between eight (8) and fourteen (14) children in care during her days and hours of operations. Based on observations and inconsistent information from interviews, LPA Nguyen is unable to determine whether licensee did or did not operate over the ratio/capacity. Based on observations and interviews, LPA David Nguyen determined that the complaint allegation was found to be UNSUBSTANTIATED, meaning although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur at the facility. Copy of this report was reviewed and provided to the licensee. Notice of site visit is posted and shall remain posted for next 30 days. An exit interview was conducted with the Licensee, Linda Roe. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
