This requirement is not met as evidenced by: Per investigation, Licensee did not report an unusual incident where a daycare child had a medical emergency in the playground and required hospitalization. This poses a potential risk to health safety of children in care.

Alterations to Existing Building or Grounds (a) Prior to making alterations or additions to a family childcare home or grounds, the licensee shall notify the Dept. of the proposed changed, including, but not limited to, the following (6) Any change from an area of the family childcare home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement is not met as evidenced by: Per investigation, outdoor swimming pool which is marked as an off-limits area is being used by children during summer days. LPAs observed children using the pool today under supervision of Licensee's spouse.

102416.5 Staffing Ratio & Capacity (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home. This requirement is not met as evidenced by: Per investigation, there were occasions when more than 8 school age children were present with Licensee or Assistant alone, and without the presence of a second qualified adult. An incident happened in the neighboring elementary school's playground during outdoor activities when Licensee was alone with 12 children under her care. This poses a potential risk to health & safety of children in care.
