What the inspector wrote

On 05/17/2023 at 8:47AM Licensing Program Analyst (LPA) A. Curry conducted an unannounced required inspection. LPA met with director Kelsey Keller and explained the purpose of today's visit. This is an infant program licensed for 32 children. This facility operates Monday \342\200\223 Friday from 7:30 AM \342\200\223 5:30 PM. Per director there are 31 children enrolled. LPA A. Curry began facility tour and all areas identified on the facility sketch were inspected. LPA observed 29 infants with 8 staff. Upon arrival, LPA observed 7 infants with an aid (See 809D) Staff indicated the other staff member left the classroom to change a child's diaper in the bathroom. Teacher-infant ratios were not observed to be in accordance with Title 22 regulations. Staff names were recorded. All children were observed to be under visual supervision of a teacher at all times. The facility was inspected to ensure that it is clean, safe, sanitary, and in good repair to ensure the safety and well being of children, employees and staff. Furniture and equipment was inspected for good repair, free of sharp, loose, or pointed parts. The facility has age appropriate furniture and equipment including but not limited to cribs, cots/mats and changing tables. LPA observed that infant changing tables are within an arm\342\200\231s reach of a sink. LPA observed sufficient infant napping equipment that meets the requirements of Title 22 regulations. LPA did not observe any baby walkers or any items that fall into that category present in the facility. At this time, an area in the classroom away from other children is used as an isolation area. Parents are contacted immediately when children are determined to be ill. The facility provides snacks for the older infant. Menus were reviewed. LPA observed that bottles, dishes, and containers of food brought by the infant\342\200\231s authorized representatives are labeled with the infant\342\200\231s name. All storage containers for solid waste, including moveable bins, have tight fitting covers on and are in good repair. Disinfectants, cleaning solutions, poisons and other items that are dangerous to children are stored in an area inaccessible to infants. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements. The licensee takes measures to keep the facility free of flies, other insects and rodents. Outdoor play equipment was observed to be in good condition, free of sharp, loose or pointed parts. Outdoor activity space surface is maintained in a safe condition and is free of hazards. LPA did not observe any bodies of water during this visit. Sign in and out sheets were reviewed. Staff Records were reviewed to ensure that personnel records are maintained on all staff. Also to ensure that Teacher\342\200\231s present have required infant units on file and are qualified. Children\342\200\231s Records were reviewed to ensure that each child has a separate, complete, and current record. LPA did not observe the LIC 9227 Individual Infant Sleeping Plan in files (See 809D). LPA issued the Children\342\200\231s Record Review (LIC 857) and the Review of Staff records (LIC 859) to the Administrator during this inspection. Criminal Records Clearance for adults and verification of CPR/First Aid and health preventative practices documentation was reviewed. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA A. Curry informed facility representative Kelsey Keller that this report dated 05/17/2023 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA A. Curry informed the facility representative to provide a copy of this licensing report dated 05/17/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted, appeal rights were given, and report was reviewed with director Kelsey Keller.

    Based on observation, interview, and record review, the licensee did not comply with the section cited above by ensuring the facility maintains ratio at all times, which poses an immediate health, safety or personal rights risk to persons in care. LPA observed 1 teacher's aid supervising 7 infants. The staff indicated the other teacher left the classroom to change an infant's diaper.

    Based on observation, interview, record review, the licensee did not comply with the section cited above ensuring that each infant up to 12 months of age has the LIC 9227 form in file, which poses/posed a potential health, safety or personal rights risk to persons in care.
