What the inspector wrote

On 05/09/2024 at 1:40 PM, Licensing Program Analyst (LPA) Christina Watts conducted an Case Management inspection at Sunnybrook Learning Center and met with Pawan "Paul" Garg and explained the purpose of this visit. During today's visit, there were no school age children in care with 4 school age staff in 2 classroom. Paul stated there are 29 school age children enrolled. All staff caring and supervising school age children have Criminal Record Clearance. LPA was conducting an complaint investigation regarding an incident that occurred in the facility about or around November 2023. A fight between children broke out in the play yard .S1 tried to break up the fight while S4 stated they did not see the fight happen. While facility was in ratio when the fight occurred, staff that are caring and supervising children are required to have 100% supervision of children in care and to be aware of any incidents that happen in the facility. Also, the facility failed to inform licensing of the incident. Per California Code of Regulations,Title 22, the Director or Designee is required to report any Unusual Incidents that occur in the facility to licensing. Furthermore, during the fight, multiple interviews stated that multiple children were hurt or injured. Per California Code of Regulations, Title 22, the facility is to provide children a healthy and safe environment that is free from any harm or danger that may cause any physical or emotional health or safety of any child. The facility is in violation of California Code of Regulations, Title 22. LPA Christina Watts informed Paul Garg that this report dated 05/09/2024 documents a Type B citation. Type B citation(s) are a potential risk(s) to the health, safety, or personal rights of children in care. *SEE LIC 809-D FOR DEFICIENCIES* Exit interview conducted and report was reviewed with the Paul Garg. A notice of site visit was given and must remain posted for 30 consecutive days.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement has not been met as evidenced by: Based on interviews, the licensee did not comply with the section cited above when S4 did not provide 100% supervision when fight occured which poses an potential risk to the health, safety or personal rights of children in care.
