1596.8662 Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter who is licensed day care provider, administrator, or employee of a licensed child day care facility; proof of completion (3) On and after January 1, 2018, a person who becomes an administrator or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a) within the first 90 days that he or she is employed at the facility and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.THIS REQUIREMENT WAS NOT MET AS EVIDENCED BY A REVIEW OF RECORDS WHICH REVEALED STAFF MEMBERS MANDATED REPORTER CERTIFICATES HAVE EXPIRED.

101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.(1) Events reported shall include the following: (C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement is not met as evidenced by: Per investigation, Licensee failed to report unusual incident to Licensing of venomous snake sighting in the premises during day care hours while children were present in the vicinity. This poses a potential risk to health and safety of children.

This requirement is not met as evidenced by: Per investigation, Licensee failed to report parents unusual incident of venomous snake sighting in the premises during day care hours while children were present in the vicinity. This poses a potential risk to health and safety of children.

CRIMINAL RECORD CLEARANCE

Based on record review the licensee did not comply with the section cited above. 2 staff SHANI ROSENBAUM and MELISSA MARICICH did not have fingerprint associations to the license. Director stated they attempted to send transfer requests to Licensing Office when staff were hired in 2018. She was under the impression they were associated. This poses/posed a potential health, safety or personal rights risk to persons in care.
