What the inspector wrote

On 7/26/21 at 3:00 PM Licensing Program Analyst (LPAs) Michelle Sutton and Monica Mathur conducted an unannounced Annual inspection Frances Luna-Robinson Family Childcare Home. Licensee Frances was not present in the home. LPA met with niece Dajhanea Luna, and explained the purpose of today's inspection. LPAs were informed that licensee is out of town for today. LPAs were granted the inspection authority to enter the Home. The family Childcare Home days and hours are Monday to Friday 6:00 AM to 6:00 PM. Present in the home at time of inspection were 7 children (1 infant, 2 preschool, 4 school age), a young male age 14; 2 helpers - Angela Sias and licensee niece Dajhanea who were helping with supervision and care, . File review shows that Dajhanea and Angela do not have fingerprint clearances or associated to the facility . LPAs spoke with Licensee over the phone, who stated Dajhanea started working July 15, 2021 and Angela was helping out for the day. Indoor Space: At 3:15 PM A health and safety tour of inside the home was done. LPAs toured the premises with licensee. LPAs observed 2 cleaning product spray bottles that are accessible to children . Outdoor Space: AT 3:45 PM LPA toured the outdoor area (backyard) and observed it was fenced . LPA observed an open fire pit table accessible to children. There is a large amount of unsafe items, equipment in the backyard accessible to children. LPA discussed with licensee that there needs to be supervision when children are outside playing. LPA observed there are no pools, hot tubs or other bodies of water. Children files and Facility files were reviewed. Licensee is reminded that ALL assistants, volunteers, frequent visitors, or adults living in the home, that are 18 years of age or older must be fingerprint cleared and associated to this facility prior to being in the presence of children in care or an immediate civil penalty will be assessed from $100 to $3000 per person, per incident. Licensee was reminded of the responsibility as a mandated reporter. Licensee is encouraged to visit the Department\342\200\231s website at www.cdss.ca.gov to access resources for Providers, Title 22 Regulations, Online option to pay Annual License fee, LPA discussed with licensee to pay annual fees, Adoption of new Laws, etc. Quarterly Updates/PINs http://www.cdss.ca.gov/inforesources/Community-Care/Self-Assessment-Guides-and-Key-Indicator-Tools/Quarterly-Updates At 5:00 PM In the areas that were evaluated, citation issued today for criminal record clearances for Dajhanea Luna and Angela Sias with a civil penalty of $600 ($100 per person per day for a maximum 5 days). Due to the issuance of a Type A citation during today's inspection, a copy of this Licensing Report must be posted in the facility and given to each existing parent by the end of today or next day child is in care. Report also has to be provided to the parent of children who are enrolled over the next 12 months. In addition, a copy of the LIC 9224 Acknowledgement of Receipt of Licensing Reports must be signed by each parent and kept in each child's file. Exit Interview was conducted with Licensee over the phone. This report, citation, civil penalty was reviewed and discussed. Report was signed by Dajhanea confirming receipt of documents. A NOTICE OF SITE VISIT WAS ISSUED, AND MUST BE POSTED ON OR ADJACENT TO THE INTERIOR SIDE OF THE MAIN DOOR INTO THE HOME FOR 30 CONSECUTIVE DAYS AND APPEAL RIGHTS WERE GIVEN.

This requirement is not met as evidenced by: Per LPAs inspection, 2 adults Angela Sias and Dajhanea Luna were present in the home during inspection and providing supervision care, did not have fingerprint clearances.This is an immediate risk to the health and safety of children. Civil Penalty of $600 assessed.

  • OPERATION OF A FAMILY CHILD CARE HOME

    102417(g)(1) Operation of a Family Child Care Home. The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to:(1) Fireplaces and open-face heaters shall be screened to prevent access by children [...]. This requirement is not met as evidenced by: Per LPA insepection, there is an outdoor furniture table with a fire pit that was observed open and accessible to children. This poses a potential risk to safety of children.

  • OPERATION OF A FAMILY CHILD CARE HOME

    102417 Operation of a Fmaily Child Care Home: Detergents, cleaning compounds, medications, and other items which could pose a danger to children shall be stored where they are inaccessible to children.This requirement is not met as evidence by LPAs observing 2 cleaning product spray bottles in the garage/play room that are accessible to children.
