What the inspector wrote

On 4/19/23 Licensing Program Analyst (LPA) Monica Mathur conducted an unannounced Required Annual Inspection at KLA Schools of Walnut Creek – Preschool program with Toddler component. LPA met with Assistant Director, Roxana Acevedo who informed that Director, Elif Kalkan would arrive later. LPA explained the purpose of today's inspection. Facility operates in: Toddler rooms - 2B, 2C Preschool rooms - 2A, 3A, 3B, 3C, 4A, 4B, TK, Kindergarten The physical plant was inspected, and LPA toured the premises with Assistant Director. INDOOR SPACE: Classrooms and restrooms were inspected. Facility was in compliance with teacher child ratios during inspection. There were some parent volunteers present. Children were engaged in various activities under the visual supervision of the teachers. At 10:00 am Director, Elf Kalkan arrived and continued walk through with LPA. Disinfectants, cleaning solutions, and other items dangerous to the health and safety of children were stored in places inaccessible to them. Cabinets, drawers, and rooms used for storage were locked. Furniture and equipment were age appropriate and in good condition, free of sharp, loose, or pointed parts. Restrooms for children were observed to be in safe, sanitary, and functioning condition. Floors were clean and free from tripping hazard. Foods and beverages were stored safely. Facility does not provide snack or lunch. Children bring their own from home, however a contingency snack is kept in case child forgets to bring food. Trash cans for solid waste had tight-fitting covers on and were in good repair. At 10:12am while inspecting Room 3C, LPA and Director found a child (C1) alone in the bathroom. Room was empty as class had transitioned outside in the play ground. C1 was left behind without visual supervision. C1 was helped and escorted outside to the class and teachers. Video footage shows they left room around 9:48 am, did not take Attendance Chart and did not realize a child was left behind. C1 was left without visual supervision for at least 24 minutes. Absence of supervision is a zero tolerance deficiency as it poses an immediate risk to safety of child/ren in care. Type A deficiency is cited with $500 civil penalty assessment on page 809-D. LPA observed a working Fire extinguisher, Smoke and Carbon Monoxide Detectors. Log shows that the last Fire Drill was conducted March 2023. Facility does not provide transportation for children, but Director understands that children cannot be left alone, unattended in parked vehicles. Required postings were observed to be posted. Facility has completed mandatory Water Lead Testing before January 2023. OUTDOOR SPACE : There are 3 play grounds that were inspected and observed to be fenced and safe. Play equipment was maintained in good condition and free of hazards. Areas around and under high climbing equipment were cushioned with material that absorbs falls. Shade is provided and there were no bodies of water observed. Drinking water is readily available to children. FILE REVIEW: Children sign in/out procedures and logs and sample of children and staff files was taken for review. There was at least one teacher with current certification in Pediatric CPR/First Aid present at the facility during inspection. Children's Roster was reviewed. This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication, equipment/supplies, children’s, personnel, and administrative records. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA Monica Mathur informed Director , Elif Kalkan that this report dated 4/19/23 with 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Mathur informed Director to provide a copy of this licensing report dated 4/19/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. In the areas that were evaluated, regulatory violation was observed. See page 809D. Director was informed a Non Compliance Meeting will be scheduled to discuss citation. Exit interview conducted and report was reviewed with the Director, Elif Kalkan. A NOTICE OF SITE VISIT was given and must remain posted for 30 days along with all pages of this report 809.

    During inspection LPA and Director found a child C1 alone in class bathroom while room children and staff had left for outdoor activity. C1 was left alone without visual supervision for at least 24 minutes. This poses an immediate health, safety or personal rights risk to persons in care. $500 civil penalty assessed.
