What the inspector wrote

The director confirmed that they do not require children to wear masks because she thought it was a recommendation. Based on the information obtained, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED and the California Code of Regulations (CCR), Title 22, Division 12, Chapter 1, Article 06, and section 101223(a)(2) is being cited on the attached LIC 9099D. Exit interview was conducted with the director and appeal rights were provided. A Notice of Site visit was provided and must remain posted for 30 days.

    101223(a) The licensee shall ensure that each child is accorded the following personal rights: (2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement has not been met as evidenced by LPM and LPA's observations of children ages 2 years and older inside of the faciity, without masks as mandated by the California Department of Public Health. This poses a potential risk to the health and safety of childen in care.
