PERSONNEL REQUIREMENTS

Based on record review, the licensee did not comply with the section cited above in both director and staff CPR/First Aid has expired which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review the licensee did not comply with the section cited above Director and staff mandated reporter training has expired which poses/posed a potential health, safety or personal rights risk to persons in care.

LIMITATIONS ON CAPACITY

A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on interviews and record review, staff did not comply with the section cited above as staff are comingling the two programs, which posed a potential threat to the health and safety of the children in care.

101212 Reporting Requirements(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (2) Information provided shall include the following:(A) Child's name, age, sex and date of admission.(B) Date and nature of event.(C) Attending physician's name, findings, and treatment, if any.(D) Disposition of the case.THIS REQUIREMENT WAS NOT MET AS EVIDENCED BY RECORD REVIEWS AND INTERVIEWS WHICH REVEALED THE FACILITY FAILED TO REPORT TO COMMUNITY CARE LICENSING, AN INCIDENT THAT OCCURED IN AUG 2024 WHEN A CHILD SUFFERED A MEDICAL EMERGENCY THAT REQUIRED CPR.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs.THIS REQUIREMENT WAS NOT MET AS EVIDENCED BY INTERVIEWS WHICH REVEALED, DURING A CHRISTMAS PARTY STAFF FAILED TO INTERVENE WHILE ONE CHILD HIT ANOTHER.

BUILDINGS AND GROUNDS

Based on observation, the licensee did not comply with the section cited above not ensuring the child care center is in good repair at all times, which poses an immediate health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Based on observation, the licensee did not comply with the section cited above by not ensuring all children are not left without supervision at any time, which poses/posed a potential health, safety or personal rights risk to persons in care.

BUILDINGS AND GROUNDS

101238Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidence by: Based on observation the facility did not comply with section cited above by ensuring the carpets are clean, sanitary, and in good repair, which poses as a potential risk to health, safety, and personal rights of children in care.

OUTDOOR ACTIVITY SPACE

101238.2 Outdoor Activity Space(d) The surface of the outdoor activity space shall be maintained:(2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard.This requirement is not met as evidence by: Based on observations the facility did not comply with the section cited above by ensuring the playground is free of hazards, which is an immediate risk to the health, safety, and personal rights of children in care.

TEACHER-CHILD RATIO

Based on observation, interview, and record review, the licensee did not comply with the section cited above ensuring the facility is maintaining ratio at all times, which poses/posed a potential health, safety or personal rights risk to persons in care. LPA observed the director and 1 aid with no units alone with 19 children.

Licensee shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. Based on interview and record review the licensee did not comply with the section cited above as outlet C exceeded the acceptable amount of lead allowed in a child care center, which poses a potential Health and Safety risk to persons in care.

101216.1(b)(1)(a) Teacher Qualifications and Duties.After employment, a teacher hired under (b) above shall complete, with passing grades, at least two units each semester or quarter until the education requirement specified in (c)(1) below is met. This requirement was not met as evidenced by record review: Staff working alone in preschool class did not have the proper qualifications. This poses a potential risk to the Personal Rights/Health and safety of children in care.
