What the inspector wrote

Licensing Program Analyst (LPA) Cherie Acosta conducted an unannounced case management inspection. The purpose of the inspection was to ensure compliance with AB2866 pool safety requirements. LPA met with Octavila Santamaria. A fingerprint cleared assistant is also present today. Edgar Orantes was not present during the visit. LPA spoke to Edgar Orantes on the telephone. Mr. Orantes stated that he took the day off. LPA reminded Mr. Orantes that he is required to be present in the home during child care hours and temporary absence shall need exceed 20 percent of the hours that the facility is providing care per day. During the inspection LPA observed a mesh fence which surrounded the pool. The mesh fence has a self closing gate that opens away from the pool. Licensee has a pool alarm, however the alarm was not properly functioning during the visit. Licensee has a rescue pole, however it does not meet the requirements specified in Health and Safety Code 1596.814. Licensee has not began logging daily inspections of the pool as required. LPA observed a life ring that is United States Coast Guard approved. During the inspection LPA observed children napping in a room with the door closed. One of the children in the room was an infant. C1 was drinking a bottle while lying in the play yard. The attached type A violation is cited today and must be corrected by the due date. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. All parents/guardians must sign an acknowledgement form of proof of receiving this report (LIC9224). The LIC 9224 must be placed in the child's file to be reviewed by licensing. See 809-D for deficiencies cited today. Notice of Site Visit was provided and must be posted for 30 days. Exit interview and report reviewed with Edgar Orantes over the telephone as Octavila Santamaria does not speak English.

    Operation of a Family Child Care Home.The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by: Edgar Orantes was not present in the home today which is a potential risk to the health and safety of children in care.

This requirement was not met as evidenced by:Alarm was not functioning properly during visit which is a potential risk to the health and safety od children in care.

This requirement was not met as evidenced by: Licensees has a pole that is adjustable and not a fixed length which is a potential risk to the health and safety of children in care.
