What the inspector wrote

Licensing Program Analyst (LPA) Cherie Acosta conducted an unannounced case management inspection. LPA met licensee Janelle Ligon. The purpose of the inspection was to ensure compliance with AB2866 pool safety requirements. When LPA arrived there were 2 infants, 1 school aged child and 5 preschool aged children in care. Licensee's assistant was not present when LPA arrived but arrived shortly after LPAs arrival. Licensee was operating out of ratio when LPA arrived. During the inspection LPA observed a mesh fence which separates the play area from the pool. The mesh fence has a self closing gate that opens away from the pool. Licensee has installed a mesh fence that surrounds the outside of the dining room window to make the pool inaccessible from the dining-room window. The fencing shall remain under review to determine if it meets the requirements specified in the Health and Safety Code. Licensee has a pool alarm, however the alarm was not sounding when an object was thrown in the pool. Licensee has purchased a life ring and a rescue pole, however these do not meet the requirements specified in Health and Safety Code 1596.814. See attached 809-D for deficiencies cited today. Notice of Site visit was provided and must be posted for 30 days. Exit interview and report reviewed with Janelle Ligon.

    Family daycare home; in-ground swimming pool requirements.A licensed family daycare home operated at a private single-family dwelling with an in-ground swimming pool on the premises shall comply with all of the following requirements: The licensee shall have the following safety equipment visible from the swimming pool and readily available for immediate use.A life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard. Licensee life ring was not Coast Guard approved which is a potential risk to the health and safety of children in care.

This requirement was not met as evidenced by: Licensees pole was adjustable and not a fixed length which is a potential risk to the health and safety of children in care.
