What the inspector wrote

On 04/09/2026 at 1:40 PM, Licensing Program Analyst (LPA) Christina Watts and Mone Flores conducted an Case Management Inspection at The Garden Community Preschool. LPA met with Director, Haley Daughterty and explained the purpose of today's inspection. During today's inspection, there were 22 preschool children with 4 staff in two classrooms. Director stated there are 55 preschool children enrolled. During the inspection, Owner, Melissa Cady came to the facility. LPA is following up on an self reported Unusual Incident Report submitted to licensing on 04/01/2026. LPA toured the facility, observed classrooms, conducted interviews and obtained relevant documents. On 03/27/2026, in the afternoon, around 4:50 PM, children were playing outside while S1 and S2 supervise. Per video footage, S1 picked up C1 and placed C1 on the climbing dome. Per the footage, S1 looks away as they place C1 on the climbing dome and C1 placed their feet on the dome but was not able to secure their hands resulting in C1 falling forward inside the dome. The footage shows S1 pick up C1 and carry C1 to S2. Footage shows S1 placing C1 into S2's arms. Footage shows S2 holding and rocking C1 until C1's parent comes into view of camera and picks up C1. California code of regulation, Title 22 stated that children are to be supervise at all times, especially on play equipment. Also, documents show that the incident occurred on 03/27/2026 and the incident was reported on 04/01/2026. California code of regulation, Title 22 stated that all facilities have 24 hours from occurrence or knowledge of occurrence to report any incidents that happen during hours of operation. This facility is out of compliance with California code of regulation, Title 22. LPA Christina Watts informed Owner, Melissa Cady that this report dated 04/09/2025 with 1 Type A citation and 1 Type B citation which shall be posted for 30 consecutive days as there is immediate and potential risk to the health, safety, or personal rights of children in care. *PAGE 2* Furthermore, LPA Watts informed the owner to provide a copy of this licensing report dated 04/09/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. *SEE LIC 809-D FOR DEFICIENCIES* Exit interview conducted and report was reviewed with the Owner, Melissa Cady. A Notice of Site Visit was given and must remain posted for 30 consecutive days.

    101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement has not been met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above when C1 was severely injured due to S1 looking away while placing child on climbing dome which poses an immediate risk to the health, safety or personal rights of children in care.
