What the inspector wrote

On 9/1/23 Licensing Program Analyst (LPA) Monica Mathur conducted an unannounced Case Management inspection at Kensington L'Academy Language Immersion Preschool. LPA met with Director, Eva Poon and explained purpose of inspection. Facility self reported an unusual incident to Licensing. Today, LPA conducted interviews, inspected facility and reviewed records. It was determined that an incident happened on 8/30/23 where Child C1's class of 3 teachers and 14 children transitioned indoor, leaving C1 unattended in the outdoor large playground, without visual supervision. C1 was alone for approximately 5-7 minutes. Another staff who was entering playground saw the child; brought them back and informed Director, Eva Poon. Child's room teachers who had transitioned inside were unaware they were missing a child. This is a zero tolerance incident and posed an immediate risk to health and safety of child in care. Type A deficiency is cited on 809-D page. Immediate civil penalty of $500 is assessed. Exit interview was conducted, this report was reviewed with Director, Eva Poon. A NOTICE OF SITE VISIT WAS ISSUED, MUST BE POSTED TO 30 DAYS. LPA Monica Mathur informed Director, Eva Poon that this report dated 9/1/23 with 1 Type A citation shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Mathur informed Director to provide a copy of this licensing report dated 9/1/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

    101238 Building & Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is not met as evidenced by: LPA observed fungal growth inside plastic wall of the boat sandbox. The plastic tarp under soft mulch was exposed in several areas, posing a tripping hazard. This poses a potential risk to health/safety of children in care.This is a repeat violation within 12 months. Civil penalty of $250 assessed.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229 Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This requirement is not met as evidenced by: C1 was left outside unattended and without visual supervision, alone for approximately 5-7 minutes. Another staff entering playground saw C1 and brought them back and informed Director. Child's room teachers were unaware they were missing a child. This posed an immediate risk to health & safety of child in care. $500 civil penalty assessed.

  • PERSONAL RIGHTS

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement has not been met as evidenced by: Facility failed to upkeep the sandbox which resulted in C1 receiving mulitple vermin bites on their body which poses an potential risk to the health, safety or personal rights of children in care.
