What the inspector wrote

On June 26, 2025, at 9:00 AM Licensing Program Analysts (LPA) Lorraine Dacanay Breaux met with licensee Mushka Rapoport for an UNANNOUNCED ANNUAL INSPECTION . Present for today's inspection was licensee, two (2) fingerprint cleared staff and six (6) children in care. The licensee is within ratio during today's visit. Upon arrival, LPA provided licensee a copy of the Entrance Checklist (LIC 126). The home was toured to conduct a Health and Safety Inspection. The facility currently operates Monday - Friday 8:00am - 5:00pm. This is a single story home consisting of 4 bedrooms, 3 bathrooms. The day care is located in the detached converted garage. The home is neat and clean with heating and ventilation for safety and comfort. The off-limits areas will be made inaccessible by closed and/or locked doors and visual supervision. Fire clearance was granted on 11/09/2023 and Licensee has met all Fire Department requirements. On-Limit Areas: The convert detached garage, and the left side of the backyard. Off-Limit Areas: Entire main home and a section of the rear yard, directly across from the main home. The home has a working smoke detector, working carbon monoxide detector, first aid kit, telephone, and fully charged 3A40BC fire extinguisher which meets standards established by the State Fire Marshall. LPA asked the licensee does she transport children and the licensee stated that she does not transport children. Per licensee she resides in the home and does not provide over night care. LIC 809-C OUTDOOR PLAY AREA: The backyard is used for outdoor play and is fully fenced and in good condition with no hazardous materials accessible to children in care. There are no other pools, hot tubs, or any other bodies of water present in the on-limit areas during today\342\200\231s inspection. Licensee confirmed there are no pools and/or bodies of water at the home during today's inspection. The licensee completed the Health and Safety training, CPR/First Aid certification expires on 08/12/25. The licensee is in compliance with the immunization laws and has completed the mandated reporter training. Licensee is reminded of their responsibility to renew CPR/First Aid and Mandated Reporter certificates every two years. The licensee conducts and documents fire and disaster drills twice a year and the last conducted drill was on 04/23/2025. All required forms are posted and visible for public review. Records: At 10:00 AM LPA Breaux request and reviewed children and staff files. LPA Breaux reviewed 3 children\342\200\231s files and personnel records for 3 of the staff. There is a current roster available for review. The facility does have liability insurance which is valid through 11/16/2025. Licensee is reminded to obtain revised admission documents for children when the child\342\200\231s home address or any other personal information changes. Criminal Record Clearance: Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Page 2 of 3 ***Continued on LIC 809C*** Safe Sleep: LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Per licensee does not administer medication during today's visit. Incidental Medical Services (IMS): Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Unusual Incident/Student Injury Report: Effective August 1, 2003 California Law requires Child Care Licensees to report unusual incidents or injuries to children in care to child\342\200\231s parents and to the Department of Social Services using the Unusual Incident/Injury Form (LIC 624). Incidents must be reported within 24 hours to the regional office by phone and the written report, LIC 624, within 7 business days. MyChildCarePlan.org: Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Megan\342\200\231s Law: During the exit interview, the licensee, Mushka Rapoport confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. There are no deficiencies cited today. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights was provided.
