What the inspector wrote

On August 8, 2024 at 9:30am Licensing Program Analyst (LPA) Indira Loza arrived at the Licensee's home for the purpose of delivering an amended report and conducting a Plan of Correction (POC) visit. Present during the visit were one school-age, one (1) preschool-age child, one (1) infant, and the Licensee's minor child. The Licensee was not present during at the home, the Licensee's fingerprint cleared assistant, Karla Urquillo Alfaro, was caring for the children. LPA toured the home for a health and safety check. On July 23, 2024 one Type A citation was issued for operating over capacity. The facility was operating within the license capacity during today's visit. Therefore the citation will be cleared. Exit interview conducted. Report and Appeal Rights provided to Assistant Karla Urquillo Alfaro.

    (a)Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement was not met as evidenced by: Based on interviews it was determined that staff were observed to be drinking alcohol in the presence of children during daycare hours, staff were yelling in front of children, staff appeared to be under the influence, and appeared wobbly. This poses an immediate risk to the health, safety, and personal rights of children in care.
