Inspector’s narrative

What the inspector wrote

On 07/18/2024, upon arrival, LPA observed that there were 17 children in the preschool classroom with a teacher and an aide. LPA verified by interview and record review that the teacher and aide, did not have the qualifications to have more than 15 children in the classroom. LPA determined the facility was out of compliance with ratio requirements by two children. Based on LPAs observations, record review, and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. This facility was previously issued a citation under Title 22 Regulation CCR 101229(a)(1) on 04/08/24, for not being in compliance with supervision requirements. This is the second citation for the same violation within a 12 month period. Civil penalties are assessed in the amount of $250.00. A civil penalty of $100.00 per day will be assessed, starting 07/19/2024, until the deficiency is corrected. See the attached LIC9099-D for two type A Title 22 Deficiencies and LIC421FC for Civil Penalty assessment. The Facility Representative was informed that this report dated 07/18/2024 documents two Type A citations which shall be posted for 30 consecutive days. The director shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and report reviewed with Facility Representative. Appeal rights were provided. A notice of site visit was given and must remain posted for 30 days.

    The licensee shall provide care and supervision as necessary to meet the children's needs.No child shall be left without the supervision of a teacher at any time..Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interview, the licensee did not ensure compliance of the section cited above by not visually supervising children at all times, which poses an immediate Health,Safety, or Personal Rights risk to persons in care.
