Based on observation, the licensee did not comply with the section cited above as multiple bottles of hand sanitizer and one container of Clorox brand cleaning wipes were accessible to children in care, which posed a potential health, safety or personal rights risk to persons in care.

Personell Records(a)The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: This requirement was not met as evidenced by: interview and record review. On 2/8/2023, Site Supervisor could not provide records for staff #1 and staff #2, thus could not provide proof that these staff met the department qualifications to provide care and supervision to children. This poses a potential risk to the health, safety and personal rights of children in care.

CRIMINAL RECORD CLEARANCE

(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or...this requirement was not met as evidenced by: interviews and record review. An Investigation revealed that staff #1 and staff #2 were present at the facility (as early as December 2022) on a daily basis for several hours a day and were providing care and supervsion to children without criminal record clearance. This poses an immediate risk to the health, safety and/personal rights risk to children in care.

False Claims.No licensee, officer or employee of a licensee shall make or disseminate any false or misleading statement regarding the child care center or any of the services provided by the center...This requirement was not met as evidenced by: Interview and Record review. On 2/8/2023, multiple staff provided false information through interview and documentation provided (Personnel Report, LIC500) regarding staff #1 and staff #2. This poses a potential health, safety and or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Current roster of children provided care in facility required. Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This requirement was not met as evidenced by record review and interview. On 2/8/2023, Site Supervisor could not provide the Department with current or past Children's Roster that contained all required information. This posed a potential risk to the health, safety and or personal rights to children in care.
