What the inspector wrote

On 04/17/2026, Licensing Program Analyst (LPA) Jeovanna Yanez conducted an unannounced Case Management - Incident inspection and was met by Teacher, Caroline Jackson. LPA toured the facility and a census was taken. The purpose of the inspection was to obtain additional information about an incident that was reported to Community Care Licensing (CCL) - Fresno Regional Office on 04/09/2026 regarding inadequate supervision resulting in inappropriate behavior between children. During today’s inspection, LPA interviewed staff, made observations, and reviewed records pertinent to the incident. Through interviews, on 04/08/2026 around 2:40 PM, Child #1 and Child #2 were playing outdoors under the play structure, running in and out of the tunnel area when Staff #1 asked Staff #2 where Child #1 and Child #2 were. Staff #2 turned and observed Child #1 and Child #2 in the tunnel area, engaging in inappropriate behavior. Staff #2 was walking towards the children when she observed the inappropriate behavior and let both children know "that is not ok." It was reported that both Child #1 and Child #2 are not allowed to be by the tunnel area, and both sets of parents were notified of the incident. The behavior during this incident was reportedly unexpected. At the time of the incident there were three (3) staff and approximately nine (9) children present in the outdoor play area, therefore, staffing ratios were in place. LPA observed the play structure and also observed a "blind spot" where children may not be easily seen. Staff also acknowledged there is a "blind spot" if not positioned or zoning correctly in this area. Although the facility followed appropriate reporting requirements and took appropriate measures to address the incident, the facility did not provide adequate supervision while both children played in the plastic tunnel. (CONTINUED ON 809-C) Based on the information obtained, LPA determined a lack of adequate supervision resulted in children engaging in inappropriate behavior. This poses a potential risk to the health, safety, or personal rights of children in care. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is deficiency being cited during today’s inspection. (See next page, LIC 809-D). Exit interview conducted and report was reviewed with Teacher, Caroline Jackson. Appeal rights were provided.

    Responsibility for Providing Care and Supervision (a) (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by interviews and observation of the outdoor play area. Information obtained determined a lack of adequate supervision resulted in child #1 and child #2 engaging in inappropriate behavior. This poses a potential risk to the health, safety or personal rights of children in care.
