What the inspector wrote

On 01/12/24, Licensing Program Manager (LPM) Juvenal Moctezuma and Licensing Program Analyst (LPA) Denisia Jimenez met with Director Tasha Avalos for an Informal meeting at the Fresno Regional Child Care Office. The purpose of today’s informal meeting was to discuss previous & recent violations of Title 22 Regulations pertaining to Childrens personal rights being violated, child sign in/out, safe sleep, and isolation of a sick child . LPM Moctezuma reviewed and discussed the following with Tasha Avalos, and how the Child Care Center will maintain compliance with the deficiencies cited below. The Department of Social Services, Community Care Licensing Division has determined that Kinder Care Learning Center violated the following Title 22 licensing regulations: On 12/27/23, LPA Jimenez issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(2), which states: (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. It was determined that inside the classroom was a pink gaming chair wrapped in 2 fitted sheets and 2 black trash bags that wreaked of cigarette smoke. On 06/23/23, LPA Baptista issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101226.1(b), which states: The licensee shall develop, maintain and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following: (1) The person who signs the child in/out shall use his/her full legal signature and shall record the time of day. During record review, LPA observed 1 out of 24 records that C1 is also on a subsidized care program and dates of attendance were entered for eight days in June that the parent or Authorized representative had not signed in the child for on the day care sign in sheet. On 10/21/22 LPA Pacheco issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101439.1(f) Infant Care Center Sleeping Equipment. Cribs shall be free from all loose articles and objects, including blankets and pillows. While taking a census LPA observed Child #2 asleep in a crib while wrapped up in a blanket. Director immediately unwrapped child #2 from the blanket and LPA provided Director with paperwork regarding Safe Sleep regulations in Child Care Centers. (Continued on 809-C) On 07/08/21 LPA Rodriguez issued a Type A citation for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(3) - (a)The licensee shall ensure that each child is accorded the following personal rights: (3): To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature. Through investigation by IB and interviews Staff #1 pulled Child #1 by their arms from underneath a table and smacked Child #1 on the face. LPA Rodriguez also assessed an immediate Civil Penalty in the amount of $500. On 04/21/20, LPA Rodriguez issued a Type B citation for violation of California Code of Regulations Title 22 Division 12 Section 101226.2(a) A center shall be equipped to isolate and care for any child who becomes ill during the day. The facility did not ensure sick children are always isolated from other children. The Director has submitted a plan of correction evidence for the above stated deficiencies. The above deficiencies were reviewed and discussed during today’s informal meeting. The deficiency for the Type B violation on 12/27/23 was cleared on 01/09/24. The Director retrained staff on personal rights regulations and had all staff sign the training verification form. The deficiency for the Type B violation on 06/23/23 was cleared on 06/23/23. Director agrees to communicate with parents the requirement to use full legal name when signing in/out children. Director had parent sign in child during inspection. The facility has implemented plans of correction for the rest of the mentioned deficiencies as well. COMPLIANCE PLAN In response to these discussions, Licensee has agreed to the following: 1 . The Director agrees to comply with Title 22, Division 12, Chapter 1 of the California Code of regulations. 2. The Director will retake the Child Care Center Orientation – Record Keeping & submit a copy of the certificate to the department by 02/09/24. This plan of correction is to ensure that director is aware of community care licensing Title 22 regulations pertaining to Childrens Personal Rights, Infant Care Safe Sleep, & Sign in/Out procedures, & care and supervision. 3. The Director will watch the Resource Provider Videos and submit in writing what she learned and how she is going to implement what she learned from the video trainings by 02/09/24. 4. Community Care Licensing will increase frequency of site visits to the facility to monitor compliance. 5. The Director will ensure children are provided with a safe and healthful environment, and comfortable accommodations furnishing, and equipment at all times. 6. The Director agrees to be referred to the (TSP) Technical Support Program. (Continued on 809-C) The Director shall submit a written plan to Community Care Licensing Division and certificate of training attended by 02/09/24 indicating how the Center will comply with the above requirements. In addition, it was recommended that the licensee connect with her local resource and referral agency for additional support and training. LPA provided the licensee with resource and referral agency phone number. Today, Tasha was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Tasha understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties. A copy of this report was given to the Director, Tasha Avalos. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
