What the inspector wrote

On 3/13/2023, Licensing Program Analyst (LPA) Ocegueda conducted an unannounced case management inspection to discuss the total number capacity and number of toilets. Today, LPA met with Director Ernestina Flores. LPA toured the facility and took a census. Today, it was determined that this facility was licensed on 4/17/2006. LPA reviewed the following regulation with Director: CCR 101239 (h) Based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children, or fraction thereof. During an annual inspection (see 809 - annual inspection report dated 3/13/2023), LPA noted that there was only one restroom with one toilet and one sink inside. In the classroom, there was a second sink. The facility did not appear to have any waivers to allow school age children to use any other restroom at the facility. Currently, they have 14 school aged children enrolled during the school year months and a total of 15 children are expected to attend during vacation and Summer months. Director stated that this was the only bathroom that the school aged children use and noted that she was told that previously the school age children used a classroom that was in the detached church (Valley Life Community Church previously named Cathedral of Light). LPA toured that classroom and observed that there were separate bathrooms. LPA could not confirm if school aged children once used a different classroom in the past. Today, LPA reviewed the regulations with Director and consulted with Licensing Program Manager via telephone during the inspection. After consultation, the Department will review pre-licensing report and file again to ensure that the facility had not obtained a bathroom waiver in the past to address the capacity of 21 school aged children and one toilet. LPA will follow up with Director Flores to provide further guidance and consultation after review. Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, no deficiency is cited today. An exit interview was conducted with Director Ernestina Flores. LIC 9213 Notice of Site Inspection will be posted for 30 days.
