What the inspector wrote

On 08/15/2023, Licensing Program Analysts (LPA) Nancy Her and Claribel Soto conducted a case management inspection and met with Center Director, Ernestina Flores. LPAs reviewed the reason of the inspection and a tour of the center was conducted both inside and outside. This is a decrease of capacity application and applicant is requesting 14 school age children ages 6-12. This facility will operate from 7:00 AM to 6:00 PM Monday through Friday. This program will operate in one classroom. Applicant is aware to contact the Fresno Community Care Licensing for a change in classrooms and/or change in capacity. Assembly Bill 2370, Chapter 676, Statutes of 2018 requires all Child Care Centers (CCCs) that are located in buildings constructed before January 1, 2010 to test their drinking water for lead contamination by January 1, 2023 and every 5 years thereafter. This facility has provided evidence of completed water testing for samples collected on 07/5/2022 with no action level exceedances noted. The classroom was observed to be clean and free of toxins. LPA observed that the furniture and equipment appeared to be safe and in good condition. The shelving units are anchored to prevent tipping onto children in care. There are enough tables, cubbies, chairs, mats and plenty of toys for children to play. LPA also reminded Center Director to not store anything on top of high bookcases that could potentially fall on children. There are working combination smoke detectors and carbon monoxide detectors in classrooms, located on the ceiling. LPA reviewed with Center Director, Ernestina Flores, that any future changes to the classrooms are required to ensure that furniture does not tip over on to children, the furniture are to be anchored or situated that tipping does not occur. Classroom changes of furniture shall be situated that 100% visual supervision is always provided to children in care. There is a restroom in the classroom with one toilet and one sink. Room measurements were taken and reviewed with Center Director, Ernestina Flores. The total inside school age area measured to an approximate 380 square feet which will only accommodate a capacity of 10 school age children at a time. There is adequate storage space available for children's belongings in the classroom. Center Director understands that children's equipment needs to match the capacity she is licensed for. Toys and equipment appear to be age appropriate. There is a total of 1 toilet and 1 sinks/hand washing fixtures which will accommodate the requested capacity of 14 preschool children. The approximate outside square footage for the preschool area is 8760 which will accommodate requested capacity of 14 preschool children. The school age play area is gated all around. LPA observed age appropriate toys and a climbing equipment that will need an age appropriate label. There is shade available where children can rest and get water. LPA reminded Center Director, Ernestina Flores, to provide adequate supervision at all times. The first fire clearance of 72 consisting of 38 preschool children, 14 school age children, and 20 infants was received on 07/02/2023. Fire clearance was approved Selma Fire Department Fire Prevention. Applicant will need to provide an updated application with the following capacities: Preschool capacity of 34, school age capacity of 14, and infant capacity of 20. A new fire clearance will need to be conducted. Currently, this facility does plan to provide Incidental Medical Services \342\200\223 IMS. A Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Center Director, Ernestina Flores, was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. The following will need to be corrected before licensure: \302\267 Updated 200A reflecting new capacity \302\267 The playground structure needs an age appropriate sticker \302\267 Updated fire clearance Pending a final file review, a recommendation will be made to license the above facility for the requested capacity of 10 school age children. LPA reviewed with Center Director, Ernestina Flores, the LIC 311A, Records To Be Maintained At The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted.
