What the inspector wrote

On 1/4/2024 an unannounced annual combination license preschool with a toddler component inspection was conducted today by Licensing Program Analyst, (LPA) Yesenia Fierro. LPA met with Director, Susan Tabatabai and toured the facility, both indoors and outdoors. The LPA observed all required licensing forms to be posted in a visible location for authorized representatives to view them. A census was taken and there were 62 day care children present, 11 toddlers and 51 preschool children. This facility runs a full day program, from 6:15 a.m.-6:00 p.m. During today\342\200\231s inspection capacity and limitations as specified on the license are being maintained. LPA Fierro conducted an inspection of the indoors and observed furniture and play equipment are in serviceable condition. Floors and carpets in the facility are clean and in serviceable conditions. There is adequate heating and ventilation for safety and comfort. All materials and surfaces accessible to children are in serviceable conditions. LPA Fierro observed that all toilets and handwashing facilities are in safe and sanitary operating condition. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All foods/beverages capable of rapid spoiling are stored in covered containers at 45 (F) degrees or less. Drinking water is available both indoors and outdoors. Solid waste storage containers have tight-fitting covers and are in good repair. LPA Fierro observed the facility is free of flies, insects, and rodents. LPA Fierro did not observe disinfectants, cleaning solutions and other dangerous items to be accessible to children. There were no poisons observed on the premises accessible to children. Licensee is aware that poisons are required to be locked and inaccessible to children. The facility has a complete first aid kit in the front reception area. LPA Fierro observed menus and daily schedule are posted at least one week in advance where an authorized representative can view them. Firearms, weapons or ammunition are not allowed or stored on the premises. There is a working fire extinguisher, smoke detector, carbon monoxide indicator, that meet statutory requirements. LPA Fierro conducted an inspection of the outdoors and observed playground and play equipment is in serviceable condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Areas around high climbing equipment, swings and slides have cushioning material to absorb falls. LPA Fierro observed the facility has an in-ground swimming pool that is fenced per regulation making it inaccessible. The pool gate is self-latching, self-closing and opens away from the swimming pool. Swimming pool is not used for infants. CON'T 809-C LPA Fierro reviewed a sample of children\342\200\231s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child, medical assessment, and immunizations recorded. LPA Fierro reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training. Staff records contain documentation of meeting qualification requirements. The name of the childcare center director or fully-qualified teacher(s) designated to act in the director\342\200\231s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. All children are under supervision, including visual supervision, of a teacher at all times. This facility does have at least one person trained in CPR and first aid. LPA reviewed with Director Susan Tabatabai the Mandated Child Abuse Reporter Training (AB 1207), which all staff have. Susan Tabatabai is aware that the Mandated Reporter Training is required to be updated every two years. This facility was built after 2010 making them exempt from lead testing. Fire drills are conducted and documented with the date, time and how many children present, at least every six months. Last fire drill conducted was 1/2/2024. Incidental Medical Services (IMS) are not currently being provided. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. There are no excluded individuals present at this facility. Licensee is aware that upon notice from the Department, any excluded individual must be immediately removed from the facility and prevented from returning to the center or having contact with children in care. The licensee shall comply with the notice. LPA and Director discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations. CON'T 809-C LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infants devices with the CPSC to be notified of any recalls on their purchased equipment. CCC was built after 2010 making them exempt from lead testing. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA referred Director to the Department website for lead: Lead Toxicity Prevention and Water Testing Information. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.
