Inspector’s narrative

What the inspector wrote

Based on the investigation, the preponderance of evidence demonstrates that a daycare staff member inappropriately handled a child in care; therefore, the above allegation is found to be SUBSTANTIATED. Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, the following deficiency is cited during today’s inspection: (See next page, LIC9099-D). Exit interview conducted and report was reviewed with Director Cristina Ortiz. Cristina was provided with appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Although the allegation may have happened or are valid. There is not a preponderance of evidence to provide the alleged violations did or did not occur; therefore, the allegation is UNSUBSTANTIATED. Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, no deficiency is cited during today’s inspection. Exit interview conducted and report was reviewed with Director Cristina Ortiz. Cristina was provided with appeal rights. This report shall be made available to the public upon request.     (a) The licensee shall ensure that each child is accorded the following personal rights, (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: During the complaint investigation, it was revealed that Staff #1 (S1) grabbed Child #1 (C1) by the shoulder while attempting to prevent C1 from leaving the classroom. This action resulted in S1 scratching C1’s neck and leaving visible marks. This posed a potential health, safety, and personal rights risk to children in care.
