What the inspector wrote

Regarding allegation 4: There is not a preponderance of evidence to prove that an adult providing care made inappropriate comments regarding children that results in a personal rights violation. This agency has investigated the above allegations. There is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED. Per California Code of Regulations Title 22 Division 12 Chapter 3, no deficiencies are being cited. An exit interview was conducted with Licensee, Esmeralda. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit inspection form is required to be posted for 30 days.

    (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement is not met as evidenced by: LPA Mercado observed in the backyard an in-ground pool that is made accessible to day care children through the livingroom sliding glass door with no pool fencing making pool accessible to day care children which poses an immediate health, safety or personal rights risk to persons in care.
