What the inspector wrote

On July 28, 2025, Licensing Program Analysts (LPA) Miguel Herrera conducted an unannounced case management inspection. LPA met with Licensee Audelia Rios to discuss the case management inspection. Licensee is Spanish Speaking and LPA Herrera assisted with interpretation. A tour of the facility was conducted, and a census was taken. LPA toured the home inside and a census was taken. LPA Herrera reviewed the current facility sketch with license. Licensee Rios confirmed that the front living room, kitchen, back living room, converted garage/day-care room, bathroom inside of day-care room, and the hall bathroom are used for providing care and are accessible to children. However, during the inspection LPA Herrera observed 4 children in the daycare\342\200\231s storage room laying in sleeping cots while they used their electronics. Licensee removed the children immediately. Additionally, LPA Herrera observed child #2 inside Licensee Rios\342\200\231 master bedroom that was to be made inaccessible to children. Licensee Rios was unable to immediately open the door as the door was locked by child #2. Eventually, Licensee Rios opened the door with a key and removed the child from the room. During the inspection LPA Herrera also observed Child #1 in a bouncer, additionally LPA Herrera observed a walker and several different types of bouncers throughout the home. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, LIC 809 D). Licensee Audelia Rios was provided with a copy of appeal rights. LIC 9213 Notice of Site visit form was provided to Licensee Audelia Rios and is required to be posted for 30 days. This report shall be made available to the public upon request .

    (g) The licensee shall document each child's immunizations as required by the California Code of Regulations, Title 17, Section 6070, and shall maintain such documentation for as long as the child is enrolled.This requirement is not met as evidenced by: Based on interviews and record reviews, Licensee did not have immunization records for 11 out of the 14 children that are enrolled in the facility. The Licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.

  • ALTERATIONS TO EXISTING BUILDING OR GROUNDS

    (a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (6) Any change from an area of the family child care home previously identified as "off limits" to an area where... care and supervision will be provided to children in care.This requirement is not met as evidenced by:Based on LPA's observations, interviews and records review. The daycare storage room and master bedroom were to be “off limits” and were not permitted for childcare use, which poses a potential health, safety or personal rights risk to persons in care.

  • OPERATION OF A FAMILY CHILD CARE HOME

    (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (10) A baby walker shall not be allowed on the premises of a family child care home in accordance with Health and Safety Code Sections... 1596.846(b) and (c).This requirement is not met as evidenced by:Based on observation, the licensee did not comply with the section cited above in that an infant was observed in a baby bouncer which posed a potential health, safety or personal rights risk to persons in care.
