Inspector’s narrative

What the inspector wrote

While the licensee stated they would check on the child every few minutes, it was found that the child remained in the room crying for approximately 30 minutes. The door to the bedroom cannot be locked, but it was reported that the door was closed with the child inside. The licensee and or/ assistant would check on the child at intervals of about 5 minutes. Although this was done to prevent the child from waking up other children, leaving a child alone in a closed room crying with no supervision violates their personal rights. Based on interviews and information reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Per California Code of Regulations, Title 22, Division 12, Chapter 3, this deficiency is being cited on the attached LIC 9099D).An exit interview conducted with Licensee, Maria Natalie Cabuto. A copy of this report and Appeal Rights were provided and discussed with Licensee, Maria Natalie Cabuto. A Notice of Site Visit Form was posted to parent's board and must remain posted for 30 days.

This requirement was not met as evidenced by: Based on interviews and records review, licensee did not ensure the personal rights of a child in care. LPA also obtained and reviewed facility records and other pertinent information related to the above allegation. It was also reviewed that a child was left alone in a room crying. This poses a potential risk to the health, safety and/or personal rights of children in care.
