What the inspector wrote

On 09/09/2024 Licensing Program Analysts (LPAs), Valentin Hernandez and Ka Vang conducted an unannounced Annual Required Inspection and was met by Licensee, Araceli Cabrera. Days and hours of operation are Monday to Friday, 8:00 a.m to 5:00 p.m. The home has working telephone service and LPAs confirmed the phone number is (559) 907-6306. Licensee confirmed that she provides meals to the children in care. LPAs toured the home inside and outside and a census was taken. Current facility sketch reviewed, and Licensee confirmed that the daycare room and hallway restroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by the use of children\342\200\231s safety gate. During the outdoor inspection, LPAs observed an in-ground pool. The in-ground swimming pool is fenced per regulation. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access to the pool area. Licensee reported that there are no firearms or ammunition on the premises. All poisons are kept in a locked storage area. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible. There is a fireplace located in the off-limits livingroom and it is made inaccessible by a screen protector. Licensee stated that the fireplace will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. There are currently no infants in care. LPAs discussed Safe Sleep Regulations with licensee. Licensee understands that there is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. (Continued on LIC809-C). Licensee understands that she is to physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. Licensee understands that Individual Infant Sleeping Plan is to be completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping. Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area in the backyard is fenced and there are no hazards to children present. Capacity as specified on the license is being maintained. Licensee stated that she has an animal in the home. Licensee has a current roster of the children. Record review indicated that there is no current fire/disaster drill completed and documented within the last 6 months. During today\342\200\231s inspection, a deficiency was cited. See LIC809-D page. Record review indicated that Licensee did not have current mandated reporter training; therefore, a deficiency was cited during today\342\200\231s inspection. See LIC809-D page. Licensee\342\200\231s pediatric CPR/First Aid expires on 12/2024. A review of records indicates that Licensee has immunization records on file for influenza, pertussis and measles. Background criminal record clearances are verified and discussed. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a family child care home. During today\342\200\231s inspection, LPAs observed an uncleared adult household (Staff #2 (S2) reside in the home. A deficiency of Type A was cited during today\342\200\231s inspection. A civil penalty of $500 for a maximum of 5 days was assessed as this regulation was violated. Incidental Medical Services (IMS) policy was discussed. LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited during today's inspection: (see next page, LIC809-D) Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 was given to licensee. Licensee was provided a copy of appeal rights. A notice of site visit was given and remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee. During the exit interview, Licensee confirmed that there are no Register Sex Offenders living in the facility and LPAS completed the RSO profile in FAS.

Licensee failed to conduct the fire and disaster drills at least once every six months. This poses a potential health, safety, or personal rights risk to children in care.

    Record reviews of the four children’s file, three children’s file (Child #2, Child #3, and Child #4) did not have proof that they have been immunized against diseases as required by the California Code of Regulations, Title 17, beginning with Section 6000.     Based on record review, the licensee did not comply with the section cited above. During record review, Staff #2 (S2) who is an adult household member and live in the home did not have background clearance. Licensee stated that S2 has been 18-year-old since 11/02/2023. This poses an immediate health, safety, or personal rights risk to children in care.
