What the inspector wrote

An unannounced case management inspection was conducted today 08/14/2025 at 1:45 p.m. by Licensing Program Analyst (LPA) Kiriko Lynch. LPA met with owner/licensee (facility representative) Kathy Vitale in response to an Unusual Incident Report self-reported by the facility on 08/11/2025, and received by the Department. Facility representative stated there was a lapse of supervision where two children, C1 and C2, were out of three staff\342\200\231s view in the classroom in a tent play structure for a period of no more than five minutes. She stated this lapse of supervision resulted in inappropriate physical interactions between C1 and C2. She stated staff rendered care to the children afterwards and observed physical injuries, specifically blood spots and bruising to the groin area of one child. She stated C1 stated to his parents that C2 had pinched his groin area so he bit C1 in his groin area. During today\342\200\231s inspection, the facility was also toured and LPA observed care and supervision to children provided by staff to children in care. Based on interviews, LPA found there was a lack of supervision to children in care which resulted in inappropriate interactions between two children and injuries to a child in care. The following deficiency is being cited on the LIC809-D. LPA Lynch informed facility representative Kathy Vitale that this report dated 08/14/2025 documents one Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Lynch informed the facility representative to provide a copy of this licensing report dated 08/14/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in children's files for verification. Exit interview conducted and report was reviewed with the facility representative Kathy Vitale. Notice of Site Visit posted. Appeal Rights were provided.

    Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time. except as specified in Sections 101216.2(e)(1)... and 101230(c)(1). Supervision shall include visual observation. This requirement was not met evidenced by interviews and records review. C1-C2 were left unattended for approximately 5-10 minutes during transition which poses an immediate risk to the health, safety, or personal rights of children in care.
