What the inspector wrote

On 9/29/2025, at 10:00am, Licensing Program Analyst (LPAs) Vicky Williamson and Jacqueline Macias conducted an unannounced Case Management inspection. LPA met with Facility Representative, Ana Hernandez and disclosed the purpose of the inspection. LPAs accompanied by Facility Representative toured the indoor and outdoor of the facility. This is a full day program which operates on a traditional school year schedule. Days and hours of operation are Monday – Friday, 8:00am – 3:00pm. There were 49 children present, 13 of whom are ages 18 - 36 months, with 13 staff members. Facility Representative reported that on 9/9/2025 at approximately 10:00am, there were two teachers and one instructional assistant supervising 13 children on the playground. Facility Representative and staff stated upon transitioning into the inside of the facility, a headcount was completed and at that time it was determined that there were 12 children inside of the classroom. Staff #1 (S1) immediately returned to the playground and observed Child #1 (C1) inside of the playhouse structure. Per staff, C1 was left unsupervised on the playground inside of the playhouse for approximately 1- 2 minutes. Facility Representative and staff stated that after an assessment of the child it was determined that the child was safe and unharmed. S1 stated that drinking water was immediately provided to C1. Facility Representative stated that she attempted to contact C1’s authorized representative; however, contact was not made until approximately 3:00pm. Interviews were conducted with the facility representative and staff. C1 declined to be interviewed and C1's authorized representative was unavailable for interview. LPA reviewed staff and children files, obtained copies of facility roster, sign in/sign out sheet, and related documentation. See LIC 809C Continuation... Based on interview statements, it was determined that C1 was left alone on the playground without supervision from 1-2 minutes. Per S1, C1 was retrieved from the playground and appeared safe and unharmed. Facility Representative stated that the staff were retrained on active supervision, conducting name-to-face head counts, transitioning procedures, positioning staff on the playground, and reporting incidents timely. Facility Representative provided the Department with a detailed action plan regarding the training. Per California Code of Regulations, Title 22, Division 12, Chapter 1, a deficiency is being cited on the attached LIC 809D. LPA informed Facility Representative, Ana Hernandez that this report dated September 29, 2025, documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Facility Representative, Ana Hernandez to provide a copy of this licensing report dated September 29, 2025, that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Facility Representative, Ana Hernandez with form LIC 9224. A Notice of Site Visit (LIC 9213) was given to Facility Representative, Ana Hernandez and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPAs observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted, and the report was reviewed with the Facility Representative, Ana Hernandez and Executive Director, Jose Martinez, Coordinators, Yadira Rosales and Gilda Gonzales.
