Inspector’s narrative

What the inspector wrote

On 2/12/24 at 1:50pm, LPAs Adrian Castellon and Michelle Hood conducted a complaint inspection to deliver complaint findings for the above allegation. LPAs met with licensees Rosemary and Diane Aguilar and discussed the purpose of the inspection. There were four day-care children present. It was alleged that Licensee disclosed confidential information about child on social media. During the course of the investigation, two unannounced inspections were conducted. Interviews were conducted with facility staff, daycare parents and children in care. Texts screen shots were obtained. Based on the interviews conducted and screen shots obtained, the allegation is substantiated. Licensee mentioned daycare child's name on a social media post. As such, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. Final findings delivered as substantiated, a type ‘B’ violations are being issued, as the situation may pose a risk to children in care. Appeal rights were discussed and given to licensee. Notice of Site Visit must be posted for 30 days.

  • 102423Type B

102423 Personal Rights (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are limited to, the following: (1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement was not met as evidenced by licensee Diane Aguilar posting a day-care child's name on a social media post. This could pose a threat to the health and safety of children in care.
