What the inspector wrote

On January 17, 2024 at 2:00 PM Licensing Program Analyst (LPA) Gloria Gonzalez conducted an unannounced, Licensee initiated, case management inspection to add a previously licensed section of the backyard and met with Licensee, Dalilia Hurtado. LPA disclosed the purpose of the inspection and was granted entry by the Licensee. The Licensee, Licensee's mother, and five (5) daycare children were present at the facility during this inspection. On 1/15/24, the Licensee submitted documentation requesting to add a previously licensed part of the backyard for daycare use. Licensee had gated off part of the backyard to make modifications. Licensee has added artificial grass and a Pergola. Licensee accompanied LPA on a tour of the home and modified backyard. LPA did not see any hazardous items and is safe for daycare children to use. The left side and back side of the yard may be used as of today, 1/17/24 for daycare use. The right side of the backyard is gated off and has an inground pool. LPA observed the pool is surrounded by a wrought iron fence and there is no door on this side of the yard and does not have access to the pool. LPA inspected the other side of the pool where the gate is and LPA observed the pool gate was left open and did not have a self-latching, self-closing gate that swings away from the pool and did not meet Title 22 requirements. See LIC809D with LIC809 CM deficiencies. A copy of the report and appeal rights (LIC 9058) and notice of site visit (LIC9213) was provided to Licensee and must remain posted for 30 days and advised must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100 . LPA interpreted and explained the inspection report to licensee in Spanish, licensee stated she understood. An exit interview was conducted and report was reviewed with the licensee, Dalila Hurtado.

Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.This requirement is not met as evidenced by: Based on observation and interiew, the licensee did not comply with the section cited above in not ensuring a self-closing, self-latching door, which poses an immediate health, safety or personal rights risk to persons in care. This is a repeat violation.
