What the inspector wrote

On July 07, 2025, Licensing Program Analyst (LPA) Isabel Ortega met with Director, Candace Monette to conduct an unannounced case management inspection. The purpose of this case management is to follow up on a self reported unusual incident report (UIR) that occurred on 7/01/2025 at approximately 4:42 p.m. during late afternoon snack. This UIR was reported to the Palmdale Regional office on 7/02/2025. At the time of the incident there were 4 children and 1 staff providing care and supervision. The unusual incident report is regarding Child #1, a child with a documented milk allergy was given Goldfish crackers as a snack which contains dairy known as allergen to child#1. LPA observed an allergy sign posted in the classroom where snacks are located, child #1\342\200\231s name is listed as having a dietary restriction- No dairy, no milk, cheese, cheese-itz, goldfish and yogurt. According to interviews conducted, observation and file review it has been determined the facility did not honor parents request for no dairy be provided to child #1. Although, physician noted \342\200\234no allergies\342\200\235 on LIC 701 Child\342\200\231s preadmission health evaluation (Physician\342\200\231s Report) at the time of initial enrollment (intake) facility and parent agreed to honor parent request. Therefore, facility did not meet Title 22 regulations and did not comply per Title 22, Facility was cited today. Facility received a Type B Violation under child's personal rights for providing child #1 with a snack-goldfish which was indicated as a food allergy by parent. On three different intake forms milk allergy was listed by parent; On consent for emergency medical treatment under child has the following allergies dated 5/27/2025, Child\342\200\231s preadmission health history- parent report under list allergies staff should be aware of- (milk allergy), and on Physician\342\200\231s report- parent made a note milk allergy above part B. Interviews disclosed at time of enrollment parents and facility had a conversation about child #1\342\200\231s milk allergy and facility made a verbal agreement child#1 will not be provided with any dairy. This poses a potential health and safety risk to children in care. Exit interview conducted copy of this report with notice of site visit and appeal rights were provided. Facility must post the Notice of site visit for 30 days visible to parents.

This requirement was not met evidence by ... LPA's observation, interviews conducted and record review. Facility did not comply with Parents request - no diary to child #1. According to facility staff was not aware goldfish contained diary. LPA observed a sign in the classroom listed with child#1's food restriction which included goldfish. This poses a potential health and safety risk to children in care.
