What the inspector wrote

On 03/13/2023 Licensing Program Analysts (LPA) Beneroso met with licensee, Marilu Garza who guided analyst on a tour of the facility for the One Year Required inspection. Upon arrival, LPA observed 3children in care and 2 adults caring for them licensee and assistant. Family members residing in the home include only the licensee and licensee\342\200\231s husband and licensee\342\200\231s daughter. Facility hours of operation are Monday-Friday 5AM- 6PM for less than 23 hours. Inspection was conducted in Spanish, LPA is certified bilingual by the department. This is a single-story home with 4 bedrooms and 2 bathrooms. Per licensee, care is provided primarily in the family room and living room. The kitchen, 1 bathrooms and 4 bedrooms are made inaccessible to children. These rooms are are off-limits and made inaccessible by use of a baby gate in the entrance areas. The backyard is accessible to children and is fenced all around but not currently being used. Laundry equipment is located the attached garage that is kept locked during business hours. The home was inspected inside and out for safety, comfort, cleanliness, telephone service, heating and ventilation, inaccessibility to poisons, detergents/cleaning compounds, medication and hazardous items that can pose a danger to children. LPA observed age appropriate safe toys and napping equipment on the premises. Naps are provided on cots the day-care room. LPA observed detergent and cleaning compounds to be kept in the kitchen in a lower cabinet with a safety latch. Medicines were observed to be kept in the kitchen in an upper cabinet. Sharp kitchen knives were also observed to be placed in the kitchen in an upper cabinet. Safe and age appropriate toys, play equipment and materials were observed throughout the facility. LPA did not observe Baby walkers, baby jumpers, baby exersaucers, baby bouncers/rockers or any other item that falls into that category in the facility. The smoke detector, carbon monoxide detector and Fire Extinguisher (2A10BC) are all in operable condition. Electrical outlets are inaccessible, there is a designated area for ill children as necessary in living room area. There are is a fireplace properly barricaded, in the living room. Per Licensee, there are no weapon/firearms in the home. The facility sketch is complete and current, there is cell phone in the facility at all times. Fire/Disaster drills are maintained current. Last fire/disaster drills were completed on March 13, 2023 . Licensee currently does not have childcare insurance. Bathroom: LPA observed toilet and faucet are clean and operable condition. No shampoos or other cleaning products were stored in the shower or cabinets. LPA observed all cabinets not to contain any cleaning products. LPA observed licensee remove all shampoos from the shower. Kitchen: Sharp utensils, are made inaccessible to children. The home has a clean and fully stocked refrigerator/freezer. Cleaning supplies are located in the lower cabinets in the kitchen. Breakfast, Lunch, AM and PM snacks are provided dinners are provided as needed. Licensee stated she currently is not participating in a food program. Outdoor: The backyard is fenced all around. The backyard is used for outside play and it is clean, free of hazards and sharp objects. LPA observed appropriate and safe toys in the play area. Per licensee and LPA\342\200\231s observations, there are no pools or bodies of water in the premises. Advisory/Other: First Aid kit was observed with supplies readily available, including a thermometer . CPR/First Aid is currently expired, license will submit proof of enrollment in a class by no later than 03/13/2023. Mandated Reporter is not current. LPA must received proof of Mandate Reporter Certificate no later than 03/13/2023. LPA reminded licensee; mandated reporter training must be completed every 2 years. Licensee had all the required posted documents: Facility License (LIC 203), Notice of Parent's Rights Poster (PUB 394), Emergency Disaster Plan (LIC 610A), and Earthquake Preparedness Checklist (LIC 9148). Children files were not complete. Licensee was cited a Type B citation for this violation. Licensee Garza was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee Garza and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) were discussed. Per licensee, the facility is not currently providing IMS. Inspection was conducted in Spanish, LPA is certified bilingual by the department. The facility was not found to be in compliance and there were citations issued. The facility was cited One Type-A deficiency as of result of the violations in accordance with Title 22 of the California Code of Regulations. Facility was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of the licensing report must also be posted for 30 days. The same report must be provided to parents/guardians of infants currently and newly enrolled at the facility during the next 12 months and facility must obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian and place it in each infant\342\200\231s file. If these requirements are not met, civil penalties per violation will be assessed. In addition, the facility was cited 4 Type B violations. A notice of site visit was given to licensee and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee Garza along with her appeal rights.
