On 11/20/23, Licensing Program Analyst (LPA) Justeene Tamayo and Licensing Program Manager(LPM) Mariela Ramon met with Licensee Deanne Rennie to inspect the facility's in ground swimming pool fencing. The pool, constructed in March 2022, does not appear to meet Title 22 Regulations. There were no day care children at the time of the inspection. Based on photographs obtained during a previous inspection on 11/17/23, photographs were obtained of the in ground swimming pool fencing and it does appear it meets Title 22 Regulations. The facility's pool is surrounded by a 4 feet 11 inches foot wired fence. The horizontal beams shall be no wider than 45 inches apart. The square openings measure at 2 inches wide and 10 inches long. The horizontal opening shall be less than 1 3/4 diameter. There is an alarm and camera (SWAM CAM) on the gate that activates when is open. The gate opens away from the body of water and it was observed to self-close and self-latch. The bottom of the fence is not the required 2 inches from the soft surface. LPA measured the bottom of the soft surface to the fencing, and it measured at 7 inches high. To address the swimming pool fencing not meeting Title 22 Regulations, the licensee is required to provide a safety plan to prevent children from accessing the backyard where the body of water is located while the new pool fencing is being constructed to meet Title 22 Regulations. The licensee has 30 days to bring the pool fencing into compliance and can request additional time if needed. Licensee plans to purchase a pool cover embossed or labeled "F 1346-91" by the American Society for Testing Materials where the pool cover shall be strong enough to completely support the weight of an adult, and shall be placed on the pool and locked while the pool is not in use. Per licensee, she still wants to utilize a pool fencing that measures at least 5 feet high and allows for visibility and sturdiness. No citation will be issued at this time, as the inspection on 06/29/23 revealed misinformation. However, the current visit is aimed at addressing the body of water fencing requirement. An exit interview was conducted, a copy of this report was read and provided to Licensee, along with her appeal rights and Notice of Site Visit.
