Inspector’s narrative

What the inspector wrote

During today\342\200\231s visit, LPAs interviewed witnesses and school staff. It was revealed through interview this incident took place sometime between 11:15a.m.-11:30 a.m. LPAs reviewed sign-in/out sheets from 08/18/2023, and reviewed facility records. LPAs reviewed Child #1's file. Adult #1, who picked up Child #1 by mistake, is listed as an authorized pick-up person for Child #2. Based upon observations, and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. Based on record review and interviews, it was determined facility did not ensure Adult #1 signed out the correct child, which resulted in absence of supervision of Child #1. Per California Code of Regulations, Title 22, Division 12, Chapter 1, this deficiency is being cited on the attached LIC 9099D. Facility was given notice of informal conference scheduled with Community Care Licensing to discuss concerns. LPA Cabrera informed Mrs. Contreras, that this report dated 08/29/2023 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Cabrera informed Mrs. Contreras to provide a copy of this licensing report dated 08/29/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Exit interview was conducted with Mrs. Contreras. A copy of this report and Appeal Rights were provided and discussed with Mrs. Contreras.

  • SIGN IN AND SIGN OUT

    The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement was not met as evidenced by: Based on interview and record review, facility did not verify sign in/out sheet for Child #1 correct authorized representative. This poses a potential risk to the health, safety, and personal rights of children in care.

    RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    The licensee shall provide care and supervision as necessary...(1) No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement was not met as evidenced by: Based on record review and interviews, facility did not ensure Child #1 was supervised by facility when releasing Child #1 to an incorrect individual, who then left facility premises. This poses an immediate risk to the health, safety, and personal rights of children in care.
