PERSONAL RIGHTS
Personal Rights. The licensee shall ensure that each child is accorded the following personal rights: to be free from corporal or unusual punishment...humiliation…ridicule…mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting… This requirement was not met as evidenced by: interviews. Licensee stated that child #1 was placed on a mat for multiple hours and was sent back to the mat when he/she tried to get up even after child #1 protested. This poses an immediate risk to the health, safety and/or personal rights of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation. This requirement was not met as evidenced by: observation and interview. On 4/27/2021, LPA's observed children unsupervised while in the play yard and while transitioning between outside and inside. Information gathered indicates that lack of supervision has occured in the facility and as a result, staff are unaware when children fight or hit others. This poses an immediate risk to the health, safety and or personal rights to children in care.

Buildings and Grounds. Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement was not met as evidenced by: observation and interview. On 4/27/2021, LPA Ocegueda observed the following: multiple cleaning solutions, paint, one sharp gardening tool and a pizza cutter in accessible drawers, cabinets and utility closet. Photos were taken and staff #1 confirmed LPA's observations. This poses a potential risk to the health, safety and/or personal rights of children in care.

TEACHER-CHILD RATIO
Teacher-Child Ratio. A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children. This requirement was not met as evidenced by: Observation and interview. On 4/27/2021, LPA's Ocegueda and Gibson counted 18 children under the supervision of staff #1 while in the play yard. LPA's reviewed this observation with licensee, and she stated that she had new staff that she was still training. This poses an immediate risk to the Health, Safety and/or Personal Rights of children in care.

The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement was not met as evidenced by: record review and interview. On 4/27/2021, LPA's observed that sign in and out sheets were signed by staff #1 at initial drop off times. Photos were taken. Sign in and out waivers for Covid-19 were discussed as a possible option. Licensee was advised that previous Provider Information Notices (PINS) addressed different Covid-19 waivers. This poses a potential risk to the health, safety and/or personal rights of children in care.
