Inspector’s narrative

What the inspector wrote

On 10/29/2025 Licensing Program Analyst (LPA), Octavia Nolan conducted an unannounced Annual Random Inspection and was met by Licensee, Karen Brooks. Also present was licensee’s assistant, Staff #1 (S1). Days and hours of operation are Monday through Friday 7:00 AM to 5:00 PM. The home has a working telephone service and LPA confirmed the phone number. Capacity as specified on the license is being maintained. LPA toured the home inside and outside. A census was taken and there were twelve daycare children present. This is a single level home and there are no stairs. LPA reviewed current facility sketch and confirmed that the kitchen, hall bathroom, family room, daycare room, and living room are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of doorknob spinners. The outdoor play area in the backyard is fenced and there are no hazards to children present. The Licensee will notify the Department prior to making an off limits area to an area where care and supervision will be provided. Safe toys and play equipment were observed and LPA discussed discarding broken toys with Licensee. There are two electric fireplaces in the home located in the living room and family room. They are made inaccessible by a glass door and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. Fire drills are conducted and documented with the date and time every six months. There is a built-in swimming pool in the backyard which is fenced and made inaccessible. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access Continued on LIC 809C to the pool area. During today’s inspection LPA discussed AB 2866 The Pool Safety Act with the Licensee. LPA observed the Licensee has obtained a pool alarm and a rescue pole. Licensee has not obtained a life ring that is a minimum of 17 inches and approved by the US Coast Guard. Licensee stated she has been completing daily inspections of her safety equipment and drowning prevention features, however she has not kept a log of the inspections for the Department to review. Licensee stated there are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible. There are pets in the home. Licensee owns one dog, cats, and ferrets. Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets. Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. LPA reviewed a sample of children’s files and observed files included emergency information as required. Licensee’s Mandated Reporter Training was completed on 10/16/2023. LPA reminded the Licensee the training must be renewed every two years following the initial date of the training. Staff #1 (S1) has not completed the required training. Licensee’s pediatric CPR/First Aid certification expires on 01/2026.LPA discussed with Licensee that all employees and/or volunteers have immunization records on file for influenza, pertussis, and measles. LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2). Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed safe sleep regulations with licensee and explained that she must complete a separate 15 min sleep log for each infant in care. The documentation must include the date, infant's name, and the time of each 15 min check. LPA reminded Licensee that all infants under 12 months must have an Individual Infant Continued on LIC 809C Sleeping Plan in their child’s file. LPA discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California. Exit interview conducted and report was reviewed with Licensee, Karen Brooks. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page LIC 809-D). Licensee was provided appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

Staff #1 (S1) has not completed the required traininig which poses a potential health, safety or personal rights risk to persons in care.
