Inspector’s narrative

What the inspector wrote

Based on observation and interview, an infant in care has napped in an unsafe manner in feeding chair. The Licensee stated the child has a pattern of falling asleep in the feeding chair. LPA Nolan observed a child sleeping in a feeding chair placed on a couch, without any measures taken to prevent tipping in a video posted to the Licensee\342\200\231s social media. Based on a review of records, the Licensee has not documented 15-minute sleep checks for infants in care. The Licensee stated she stopped completing the documentation after infants reached twelve months. The California Code of Regulations requires the Licensee to document the sleep checks until infants are 24 months. The documentation must also be available for Department review. LPA provided the Licensee with a copy of Infant Safe Sleep regulations. Based on observations, documentation, and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegations are SUBSTANTIATED. Exit interview conducted and report was reviewed with Licensee, Isabel Pardo. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page LIC 9099-D). Licensee was provided appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

  • PERSONAL RIGHTS

    (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement was not met as evidenced by: the Licensee has seperated children based on the developmental needs which poses a potential health, safety or personal rights risk to persons in care.

    INFANT SAFE SLEEP

    (i) If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard as soon as possible. This requirement was not met as evidenced by: based on observation and interview, an infant in care has fallen alseep in a feeding chair that was placed on couch without any safety restraints. The Licensee also has not documented sleep checks for the infant after the child reached twelve months of age which poses a potential health, safety or personal rights risk to persons in care.
