Inspector’s narrative

What the inspector wrote

The maximum Small FCCH capacity is 8 children, therefore, the Licensee was over capacity with one additional child in care. Based on available information, and LPA observations the preponderance of evidence standard has been met, therefore, the allegation is Substantiated. The following violations of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 9099D. Reports citing Type A violations are to be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled. This report was reviewed and discussed with the Licensee. LS\342\200\231s signature was not recorded on this Complaint Investigation Report (CIR), however, this report was reviewed and discussed with LS, LS was provided with a copy of this CIR; and Appeal Rights, LS\342\200\231s signature will be on file. All licensing reports are public information and must be made available upon request for at least three years.

The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time.This requirement was not met as evidenced by: Based on an interview conducted with the Licensee, which corroborated that the Licensee operated over her license capacity in the month of January 2021. This posed an immediate Health, Safety & Personal risk to the children in care.
