What the inspector wrote

(Continued from LIC 9099-C) LS and S1 stated that the daycare children have been playing only in the front yard for the past 2 months due to the backyard being under construction. LS stated the backyard is made inaccessible by child gate and locking the door to the backyard. In addition, LS and S1 stated when the backyard was in use, the daycare children are not allowed to climb on the backyard fence. LS and S1 stated there are two staff present at the facility and when outdoors there is at least one staff member who is present with the children. LS and S1 further stated when a child needs to use the bathroom, the other staff member would assist the child inside to use the bathroom. Additionally, LS stated while an assistant is outside with the children, she would prepare lunches inside but can view them from the kitchen window. LS did state from a past incident the older daycare children used to sit on top of a playhouse which was not allowed by the younger daycare children. LS also stated the children are only allowed to use the climbing dome structure when they have the ability to safely climb up and down the structure. According to LPA\342\200\231s observations on 08/22/2024 multiple dog feces were observed in the on-limits backyard area, but the backyard area was made inaccessible by a child gate. From Children interviews, C1 stated that the children are not allowed to climb the backyard fence and have not climbed it. Interview from C2 stated, recently the daycare children have been playing in the front yard and interviews from Adults (A1 & A2) stated to recently observe the daycare children using the front yard, corroborates the LS and S1\342\200\231s statements. Interviews conducted by Adults (A4 & A5) had no current concerns with the facility at this time. Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Licensee, Jacquelyn Joyce. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
