What the inspector wrote

An unannounced Case Management \342\200\223 Legal/Non-Compliance visit was made by Licensing Program Analyst (LPA), Leticia Rosales-Meza and Licensing Program Manager (LPM), Melchisedeck Augustin, who met with Licensee (LS), Marisol Abundis Guzman, for the purpose of serving a Temporary Suspension Order (TSO) of the Family Child Care Home license and the Immediate Exclusion Orders (IEO) of Marisol Guzman Abundis. LPM explained the nature and purpose of the visit. The TSO packet served and explained to Marisol Abundis Guzman, who accepted the accusation and exclusion order at 1:15pm . During the visit, there were five children in the care of LS. The following TSO and IEO documents were provided and explained to the licensee: 1: Temporary Suspension Order (TSO) 2. Order for Immediate Exclusion for Marisol Abundis Guzman. 3: Statement to Respondent 4: Government Code Statutes 5: Summary Instructions for Licensee 6: Summary of Charges 7: Accusation Continue on LIC9099-C 8: Request for Discovery 9: Notice of Defense (2 copies) While the order is in effect, the licensee is prohibited from operating the child day care facility. The written notice of the TSO was taped on the outside of the front door and must remain as long as the order is in effect. Licensee was informed that removal of this notice constitutes a violation of the law, a misdemeanor fine of up to $500.00. The licensee shall post and provide copies of this licensing report to all parents/guardians and must give a copy of the Summary of Charges to the parent or legal guardian of each child receiving services in the facility until the Accusation is either dismissed or resolved through the administrative process or Stipulated agreement. Each parent/guardian receiving a copy of the Summary of Charges shall sign and date form LIC9224, Acknowledgement of Receipt of Licensing Reports.

    The licensee shall report to the Department as provided by Health and Safety Code Sections 1597.467(b)(1) and (2).This requirement was not met as evidenced by: Based on Department records revealing that the Licensee did not notify the Department of any incident(s) involving C1 & C3 being bitten by another child. This poses/posed a potential health, safety, and/or personal rights rights to the children in care.

  • ALTERATIONS TO EXISTING BUILDING OR GROUNDS

    Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care.Based on PD reports obtained by IB confirming the Licensee allowed C1 to wander and access an off-limits bedroom. This posed an immediate health, safety, and/or personal rights risk to the children in care.

    OPERATION OF A FAMILY CHILD CARE HOME

    The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.This requirement was not met as evidenced by: Based on PD records obtained by IB confirming the Licensee left a daycare child unattended in an off-limits bedroom, which posed an immediate health, safety, and/or personal rights risk to the children in care.

  • PERSONAL RIGHTS

    Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.This requirement was not met as evidenced by: Based on PD records obtained by IB confirming C1 was inappropriately touched over their clothes by C2 in an off-limits bedroom, which posed an immediate health, safety, and/or personal rights risk to the children in care.
