What the inspector wrote

The child #1 was later found by another staff member inside the van. The Director admitted that she did not notify the Department about the incident and did not file an incident report. While the Director claimed that the child’s parents were notified, she could not provide a copy of the incident report to the LPA. The LPA also did not find an incident report in the child’s folder. The LPA interviewed child #1 and they could not recall specific details about the incident but mentioned that they had fallen asleep. Parent #1 recalled the incident from last summer and confirmed that the facility had informed her about the child being left unattended in the vehicle. According to Parent #1, the child was fine after the incident and did not require medical treatment. This agency has investigated the complaint alleging staff left day care child unattended and staff did not report an incident involving a day care child as required. Based on LPAs observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations are being cited on the attached LIC 9099D. Licensing staff informed Facility Representative a copy of this licensing report dated 08/01/24 that documents any Type A citation(s) need to provide to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit Interview was conducted, a copy of this report along with Notice of Site visit , Deficiency pages and Appeal Rights were explained and provided to the Facility Representative , Patricia Chambers on 08/01/2024. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100. Page 2 of 2 Based on the staff interviews teacher assistant does not supervise children without qualified teacher ,if additional help needed staff calls the office .Parents disclose there is always a teacher with the helper. This agency has investigated the complaint alleging : Unqualified staff are providing care to day care children without supervision .Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. No citations issued at this time . Exit interview conducted with Facility Representative , Patricia Chambers. The Notice of site visit , report and Appeal Rights were explained and provided to Facility Representative on 08/01/2024.
