Inspector’s narrative

What the inspector wrote

The allegations indicate that \342\200\234Staff are not isolating sick children.\342\200\235 and \342\200\234Staff did not provide a safe environment for daycare children.\342\200\235 Per the Reporting Party (RP), the school does not have an isolation area for sick children, and these children remain in the same area as all the other children. Some children who present with obvious symptoms such as a runny nose and cough are not sent home immediately, and the remaining children are then exposed to sick children. When interviewed, all parents and staff stated that the facility does not have an infant isolation room. All the sick infants remain in the classroom until the parents pick them up. The parents are not always able to pick the children up immediately, and therefore, the other children are exposed to sick children. During the first inspection conducted by LPM, Betty Bell, and LPA, Ellorine Jankins, they observed a room with a sign designated for isolation was not equipped with a crib, cot or mat for each infant requiring isolation. Based on observations and interviews conducted the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 1, Subchapter 02. Infant Care Centers, Section 101426.2 Infant Care Isolation for Illness and Title 22, Division 12 Chapter 1, Article 06, Continuing Requirements, Section 101223 Personal Rights are being cited on the attached LIC9099D. Please refer to LIC9099D for documentation of deficiencies. Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Elizabeth Orozco, Director.

    Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: The infants are exposed to those infants who are ill during the day and are not immediately picked up or isolated which poses a potential Health or Safety, or personal rights risk to persons in care.

    Infant Care Isolation for Illness: The isolation area shall be equipped with a crib, cot, mat, or playpen for each ill infant. This requirement is not met as evidenced by: The school does not have an equipped isolation area for infants who become ill during the day to isolate themselves from other children which poses a potential Health or Safety, or personal rights risk to persons in care.

    Indoor Activity Space for Infants:The sleeping area for infants shall be physically separate from the indoor activity space. This separation shall be accomplished as specified in (b) above. This requirement is not met as evidenced by: the sleeping area for infants is not physically separate from the indoor activity space which poses a potential Health or Safety, or personal rights risk to persons in care.
