What the inspector wrote

**This is an Amended Report created on 11/19/2025 by Licensing Program Analyst (LPA) Mariah Aguirre** On November 18th 2025 Licensing Program Analysts (LPAs) Mariah Aguirre and Monique Ayala conducted a case management inspection due to an incident that occurred at the facility on 10/29/2025. LPAs met with Preschool Director Lori Munoz, who guided LPAs on a tour of the facility to obtain the census of 95 children with 12 staff. The facility had self reported the incident to the Department on 10/30/2025. Unusual Incident Report (UIR) was received via email. The UIR consisted of a possible personal rights violation. During the inspection, LPAs conducted interviews with Staff #1-3 (S1-S3), Children #1 and #2 (C1, C2) and Parent #1 (P1) and obtained a current children's roster. Based on Interviews conducted, an incident occurred between S3 and C1 while C1 was placed in "time-out". Per S3, they were holding C1 on their lap, restricting movement. Per S3, C1 did not want to be held by S3, causing C1 to hit S3 in the face. Per S3, while attempting to block a second hit from occurring from C1, S3 blocked C1 from hitting S3, and in the process scratched C1 on the chin with their thumb. C1 stated that they did not like being held by S3 and demonstrated on a stuffed animal how S3 was restraining C1. Per P1, S3 notified P1 of the incident and an incident report was provided to P1. C2 and S2 made no disclosures. Disclosed in interviews, S1 and S3 stated that restraining children is used as a form of redirection. LPAs informed S1 and S3 that restraining children is a personal rights violation. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety. LPAs Mariah Aguirre and Monique Ayala informed the Preschool Director Lori Munoz to provide a copy of this licensing report dated 11/19/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report, A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child\342\200\231s file for verification. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Preschool Director Lori Munoz. Page 2 of 2

This requirement was not met as evidence by: Based on interviewed it was disclosed that C1 obtained an injury on their chin while S3 was restraining C1. Per S1, they also have restrained C1. This is an immediate health and safety risk to children in care.
