What the inspector wrote

On 06/01/2023, at 12:00 PM, Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility- appropriate PPE was used. LPA met with facility Director Marcia Cagigas during the visit. Census was taken-. facility was within ratio & capacity. Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided facility sketch and required forms LIC 9276, LIC999 and LIC9275 to the department on 04/21/2023. On 5/12/2023, the Department received notification from the State Water Resources Control Board(SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 04/21/2023. ----------------------------- pg. 1 of 2 ---------------------------------------------------- Faucets reported with 5.5 ppb or greater lead exceedance levels were as follows: \342\200\242 Kitchen Faucet B (25.00 UG/L) \342\200\223 During inspection LPA observed a caution do not use sign posted on faucet- Picture was taken Director stated that facilities director has been informed and they are waiting for parts to arrived to replace faucet. Once faucet is replaced it will be retested and results will be submitted to the department. LPA did observed other sinks available in the kitchen that did not have lead exceedance. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. A notice of site visit was also provided and must remain posted for 30 days . Failure to comply with posting requirements shall result in an immediate civil penalty of $100.     Based on observation, the licensee did not comply with the section cited above in that LPA observed disinfectants sprays (honest and lysol) in an unlocked cabinet in room 115 which poses/posed a potential health, safety or personal rights risk to persons in care.

    3a) within the first 90 days that he or she is employed at the facility and shall complete renewal mandated reporter training... Based on record review the licensee did not comply with the section cited above in that Staff 2,6 & 9 did not complete training within 90 days of employment which poses/posed a potential health, safety or personal rights risk to persons in care.
